In the event of any conflict between these Terms and a Service Agreement, the terms of the applicable Service Agreement will control with respect to the specific client relationship and services.
Nothing on the Site constitutes a binding offer to provide services; all services are subject to acceptance by Amped Marketing through a signed Service Agreement or other written confirmation.
Intellectual Property Rights

Dispute Resolution
Before filing any formal legal claim, you agree to first contact Amped Marketing to attempt to resolve the dispute informally. If the dispute cannot be resolved informally within a reasonable time, either party may pursue available legal or equitable remedies in the courts specified under “Governing Law and Jurisdiction.”
If you are a client with a Service Agreement that includes an arbitration clause or specific dispute resolution procedure, that clause or procedure will govern any disputes arising from the Services covered by that agreement.
Severability and Waiver
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect. No waiver by Amped Marketing of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
Entire Agreement
These Terms, together with any Service Agreements entered into between you and Amped Marketing and any other legal notices or policies posted on the Site (including our Privacy Policy), constitute the entire agreement between you and Amped Marketing regarding your use of the Site and Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
